Maternal mental health is a major public health issue. Illinois Public Act 100-0574 was signed into law January 8th, 2018. The law will allow postpartum depression or postpartum psychosis to be considered a mitigating factor in forcible felonies committed by women who were neither treated nor evidence of postpartum depression or postpartum psychosis was presented prior to their trials. This legislation is the first of its kind to pass in the United States and will go into effect June 1st, 2018. This policy analysis will describe the strengths and limitations of this policy in its current form.
